Supreme Courts Confers Again November 25

The Supreme Court now lists our case among those to be discussed at the justices' conference next Tuesday, November 25. Clearly, there was something too complicated in their original discussion for them to make a snap decision on whether to hear the appeal, but saying anything beyond that would be speculation. Our wait for further word resets accordingly.

All that possibly can be known at this point about the new date is that our case is now scheduled for conference on 11/25; there is no way to know why it was rescheduled and/or if any discussion even took place on 11/14. Also, the Supreme Court does not make a "snap decision" at the conference; although a lot of cases are voted on quickly, the Justices (and/or their clerks) have put in considerable time studying the briefs for each case in the
pre-conference process. The justices "do their homework" and thus can proceed with a degree of speed. But they are not making "snap" decisions.
